SHORT-TERM RENTAL AGREEMENT 

This is not a confirmation. Below are your reservation details and payment schedule. Reservations are not confirmed until the rentalagreement has been completed within 24 hours of the booking and the deposit has been charged. A Confirmation will be texted to you upon final payment. If you have paid in-full, a confirmation will be texted to you following the submission of this rental agreement. 

**BonHom highly recommends purchasing Travel Insurance to protect your vacation plans and your non-refundable deposits.  CSA Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance reimburses for pre-paid, nonrefundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. We strongly recommend you purchase this valuable protection. If declined, you acknowledge you have read and understand our cancellation policy and choose not to purchase Vacation RentalInsurance on behalf of all occupants.

The following information is part of this Agreement: 

Guest:

The Guest agrees to the following terms for the use of the Accommodations between the Arrival and Departure Dates listed above. 

1. Age Requirement: Guest paying and signing for rental must be 25 years or older and must be present at check-in.  

2. Deposit and Cancellation Policy: At the time of booking: A payment equal to 50% of the reservation total is required. If the reservation is made within 30 days of arrival, full payment will be collected at the time of booking

Up to 60 days before arrival: The 50% payment is fully refundable if you cancel your reservation.

Between 60 and 30 days before arrival: The 50% payment becomes non-refundable. No additional payments are required during this period.

30 days before arrival: The full payment for the reservation is due via an ACH payment (see section 3).

Within 30 days of arrival: No refunds will be issued if you cancel your reservation. 

3. Credit Card Terms: The Guest authorizes the Manager to charge any sums due under this Agreement to any credit card account held and provided by renter at the time of booking. All Credit Card charges for final payment are subject to a 3.5% convenience fee. The 3.5% convenience fee does not apply if the balance is paid in full at the time of booking with one payment nor does it apply to the first 50% payment. 

Final payment is NOT automatically charged to the credit card on file. If you do not pay in full when the reservation is made, final payment is due by ACH payment (wire transfer if the guest is making a payment from outside of the USA) 30 days prior to the reservation start date.

Failure to provide payment consistent with the payment schedule in section 2 will result in the cancellation of the reservation and forfeiture of all monies paid. 

4. Check-In/Check-Out: The Accommodations will be available for occupancy beginning at 4:00pm on the Check-In Date, and must be vacated by 10:00am on the Check-Out Date. Departures after 10:00am will incur a minimum $75/hour fee unless prior arrangements are made in advance with BonHom. 

5. Parking: The maximum number of parking spots is property specific and listed in the rental agreement.  Any additional vehicles must be parked in the various lots around town. 

6. Damage : The Guest will provide a credit card and authorizes the Manager to use the credit card to cover excessive housekeeping costs and damages not associated with normal wear and tear. This credit card will remain on file for the duration of your stay and further until we are able to inspect the property after your departure. The guest understands that this agreement in no way limits their liability and the guest accepts responsibility for any damages caused during their stay. 

7. Location/Maximum Occupancy: The Guest will permit no more than the Maximum Occupancy. 

8. Communication and Property Access: The guest agrees to receive communications (including the rental agreement and all property access instructions and information) via text message to the phone number that is supplied at the time of booking. The guest will also be required to supply a current photo of themselves and a photo of their state-issued identification for the sole purpose of identity verification, and a credit card for the damage deposit through the same text-based communications.  

9. House Rules: The Guest agrees to follow all house rules posted in the Accommodations or provided to the Guest at check-in. While using the Accommodations, the Guest will abide by all applicable governmental laws and regulations and will be responsible for all damage to the Accommodations beyond ordinary wear and tear. The Guest agrees to indemnify and hold the Manager harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the Accommodations by the Guest’s tenants, the Guests, or from any carelessness, neglect or improper conduct of any persons entering, occupying or visiting the Accommodations. 

10. Parties/events: No house parties or events of any kind are permitted, including weddings, wedding parties and receptions, and any social events more than the maximum occupancy of the property.  Any violation of this policy will result in eviction of all guests, as well as loss of rent and damage deposit. 

11. Housekeeping Service: Prior to your arrival, the property is thoroughly cleaned and supplied with fresh linens, towels, soaps, and paper products.  Our rates do not include maid service during your stay; however, housekeeping services may be arranged with at least a 48 hour notice for an extra charge (based on availability). Additional payment will be taken at the time of the request. 

12. Trash Removal: The Guest agrees to deposit accumulated household trash in either the complex trash dumpster located on site or a trash container for a home in or outside the garage. 

13. Amenity Starter Set: The unit will be set up for your arrival with towels and linens, included free with your stay. The unit will also be stocked with a limited supply of shampoo, conditioner, soap, lotion, toilet paper, Kleenex, paper towels, trash bags, and detergents. Quantities of these items greater than what is stocked are the renter’s responsibility to purchase. 

14. Utilities: The rent includes utilities (water, heat, electricity, WIFI, and cable or satellite TV. 

15. Pets and Service Animals

               15.1 Service animals, as defined pursuant to regulations under the Americans with Disabilities Act, are allowed to accompany Guests during their stay. Service animals must be individually trained to perform a task for the benefit of an individual with a disability. Animals providing emotional support, comfort or companionship are not service animals. Guests must notify BonHom at the time of reservation if they will be bringing a service animal. Service animals may be removed if they are disruptive, aggressive, or not housebroken.

Under Florida law, it is a criminal offense to misrepresent an animal as a service animal. Florida Statute § 413.08(9)

               15.2 Pets (Dogs Only) are allowed in pet friendly properties only with the written authorization of BonHom. Unauthorized pets are prohibited from entering any home without prior notification and authorization. 

               – No more than 2 dogs are allowed in a rental home. 

– The guest agrees to pay a nightly rate of $50 per dog. Unauthorized animals brought into a rental will incur a $300 charge in addition to any additional cleaning costs. 

Dogs must adhere to the following rules:

– No barking or excessive noise. Complaints from neighbors will result in the animal being   removed from the home. Pet boarding cost is the sole responsibility of the renter. 

– The guest is responsible for the removal of any pet waste on property.

– Damage to the home or its furnishings are the sole responsibility of the renter, including but not limited to scratches to wood furnishings and doors and pet waste removal. Guests must notify BonHom of any damage to the home.

– Dogs outside must be on leash 

– Dogs are not permitted on furniture or beds at any time. Any evidence of animals on furniture will result in additional cleaning fees. 

– Dogs may not be left unattended on the balcony, patio, or porch. 

16. Smoking, and Marijuana: No smoking of tobacco or marijuana products is permitted in the Accommodations. Condo guests are also restricted from smoking on balconies or in condo common areas. Unauthorized pets, smoking, and/or marijuana products/usage will each result in a penalty of $300 in addition to the cost of extra cleaning due to guest smoking in a rental home.  

17. Bunk Beds: BonHom and the Homeowner assume no responsibility for improper use of bunk beds. Top bunks are intended for children no younger than 6 years old, and guests not exceeding 170 lbs. in weight. Guests or their children should use the ladder when entering and exiting the top bunk. No horseplay or jumping onto or from the bunk or ladder . 

18. Entry of Premises: An authorized employee or repairman may enter the premises during customary business hours for any purpose connected with the repair, improvement, care, and management of the premises. 

19. Unit Assignment: In the rare event of booking conflicts with homeowners or unforeseen maintenance emergencies, we reserve the right to substitute comparable accommodations up to and including the day of arrival, provided the guest is not charged a higher rate than the accommodation type originally reserved. 

20. Amenities: In the event that a private hot tub or fireplace in a rental property becomes inoperable during your stay, we will make all attempts to correct the problem as soon as possible and refund a maximum of $25 per day.  This does not apply to shared hot tubs and/or recreational facilities where the guest has access.

21. Cap on Liability: Notwithstanding anything to the contrary contained in this Agreement or elsewhere, the liability of Manager for any damage or loss arising pursuant to or in connection with the representations, warranties, indemnifications, covenants or other obligations (whether express or implied) of Manager under this Agreement, regardless of whether the action or claim is based on contract, tort, warranty or otherwise, will not exceed the total amount paid, if any, by Guest to Manager. 

22. Holdovers: If the Guest does not vacate in a timely fashion, the Guest will be subject to eviction and the rental amount due for any full or partial day following the specified check-out time in the amount of $150/hour rate. 

23. Notices: Notice to either party shall be in writing to the mailing or e-mail addresses shown at the top of this Agreement. Notice to the Guest during the occupancy period shall be by personal delivery to the Guest at the Accommodations. 

24. Disputes: Any sums due from the Guest to the Manager shall accrue interest at the rate of 1.5% per month until paid. Any dispute relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Walton County, State of Florida, and shall be governed by Florida law. If the Manager hires legal counsel to enforce the terms of this Agreement or to resolve any dispute under this Agreement, the Guest shall be liable for all attorney’s fees and costs incurred by the Manager.
